General Data Protection Regulation is a legal framework that sets guidelines for the collection and processing of personal information from individuals who live in the European Union (EU).
This means that I have to handle the information you provide to me properly and safely. Here is the compliant Privacy and Policy for Nelli Schmidt Photography.
Personal Data
I am asking you to provide your name, your email address, your postal address and your phone number. This information is required for me to communicate with you when you hire me to photograph your wedding, event or portrait session and provide you with the online gallery, or prints included in your booking. You hired me to take photographs of you, that for it is entirely necessary for me to have the information to do my job properly.
The mailbox which the contact form arrives in when you use it on my website is passworded with 2 factor authentication. As soon as you book me as your photographer I will transfer all your data in a secure database. If you decide not to book my service after inquiring, all information you have provided will be deleted.
Blog and Social Media
My blog and social media accounts such as Instagram and Facebook are public, your comments are viable publicly. A private message on Facebook will be answered with an automated message encouraging you to use the contact form on my wed page. If Facebook is still your choice of communication, my account as well is secured with two factor verification.
Right of Confirmation, Access, Correction and Erasure
If you wish to have insight into the information I have stored about you, please don't hesitate to ask me to provide you with my notes. In case you wish to change details you have the full rights to correct it or erase it. If you delete all the data you provided to me, it will make my job extremely difficult as I wont be able to communicate with you or send you the online gallery, prints or album you have booked within your wedding / photoshoot package. It is required for me to have all the information I asked you for in the contact form on my webpage to provide you with all services and products you have booked. As soon as you received all of the above I can erase all details about you if you wish, I can not assure the total security of your online gallery as long as it is online.
Use of Data
To provide you with the best service possible I will contact you online through your email address. I will only send you appropriate wedding or portrait photoshoot related questions or information. I will not send you any newsletters or promotion material. If you would like to book me for any further services after your wedding / photoshoot, you can simply contact me again though the contact form on my webpage.
I might provide a second shooter with your phone number so they are able to contact you on your wedding day if required. In the contract of which you are a party I will ask you for some details about your wedding / photoshoot to be able to do the best job possible for you. The information you provide in the contract will be stored in my secure database or my password locked phone. After your wedding / photoshoot I might send you a questionnaire or email about a social media / blog post. You are not obligated to follow my requests. In case you do answer the questions or write a review on my services voluntarily, I might use those to edit them into a blog post or social media post.
In case of an inquiry from independent blogs, magazines or social media accounts related to photography, wedding services / products, fashion or life style I will contact you before the publication and ask you for your permission before.
Use of Your Face-based Data
I have the obligation to demonstrate ligtamate and reasonable use of your photographs, which means I will not sell your photographs for inappropriate and horrific advertisement. If a third party approaches me wanting to purchase a beautiful photograph of you, I will contact you and inform you about the financial aspect of it. You might want to have an option to earn from an advert in a wedding, family, lifestyle or photography related magazine or online publication. It will only go ahead with your consent.
To be able to run my business successfully I have to show my photographs to potential clients. I do so on varius social media platforms such as Instagram, Facebook and Pinterest or on my website. I also showcase my photography in sample albums. That is why I ask you to opt into this in my contract. You have also the option to keep your photographs private if you are uncomfortable to see yourself on my social media platforms, my website or my sample albums. This results in a 20% increase of the package price.
Under no circumstances will you see your photographs on the internet before you have seen them yourself. If you don't like certain photos to be shown you can veto those. It is your responsibility to get your wedding guests or attendees of your event's permission for their photographs to be shown.
I store your photographs on a password encrypted hard drive in my house locked away safely. I keep a second back up on a separate hard drive which is also password protected. I share a copy of the files with you through an online gallery provider, or a file transfer platform which is GDPR compliant. To access your gallery I provide you with a password and a download pin which can only be shared by you. After a limited amount of time, which we agreed on I remove your online gallery but keep your photographs on the encrypted hard drives for a maximum of 5 years.
I protect your photographs in the best possible way to ensure that none of them are being used on the internet without the consent of us both.
